Oregon Traffic Courts

Oregon contests civil traffic violations through trial by written declaration under ORS 153.070. Every circuit and municipal court listed below accepts a written declaration by mail in lieu of appearance. If you lose, ORS 153.080 gives you 30 days to request a trial de novo — a brand-new in-person trial.

How the Oregon Trial by Written Declaration works

ORS 153.070 lets you enter a not-guilty plea and request a trial by written declaration. Within 30 days of the citation, mail your request along with your written declaration of defense — photos, diagrams, and witness statements are welcome. The officer files their own written declaration; the judge reads both and rules in writing. No bond is required. If you lose, ORS 153.080 gives you 30 days to request a trial de novo (a new, in-person trial).
