Miami-Dade accepts a written Affidavit of Defense under Florida Rule of Traffic Court 6.340 in lieu of a personal appearance. The affidavit must be sworn and notarized, and you must post a bond — in Miami-Dade, a cashier’s check or money order for the full civil penalty plus the clerk’s fee. The packet must reach the Traffic Division at least 5 business days before your scheduled hearing. The hearing officer reviews your statement together with the officer’s report and rules in writing.

Pay your civil penalty

Florida lets you resolve most non-criminal infractions online by paying the civil penalty within 30 days. Pay through Miami-Dade Clerk of Courts (Traffic Division)’s online pay portal.

Buy yourself more time — request an extension

Every extra week between the citation and your filing is another week the officer can forget. Florida courts routinely grant first-time extension requests as a matter of course — you generally do not need a hardship reason.
